TERMS AND CONDITIONS OF SERVICE

Ceyora Hosting (Sri Lanka)

These Terms and Conditions of Service (“Agreement”) constitute a legally binding agreement between Ceyora Hosting, a company incorporated in Sri Lanka (hereinafter referred to as “Ceyora”, “Company”, “we”, “us”, or “our”), and the client, customer, user, or entity purchasing or using our services (hereinafter referred to as “Client”, “User”, or “you”).

By ordering, accessing, or using any service provided by Ceyora, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. Scope of Services

Ceyora provides technology infrastructure and internet-based services in Sri Lanka and internationally, including but not limited to:

• Shared Web Hosting
• Virtual Private Servers (VPS)
• Dedicated Servers
• Application Hosting
• Domain Registration & Domain Reseller Services

All services are provided subject to availability, technical feasibility, and compliance with this Agreement.

2. Eligibility and Authority

You confirm that:

• You are legally capable of entering into binding agreements;
• If acting on behalf of a business, organization, or government entity, you are duly authorized to bind such entity;
• All information provided to Ceyora is accurate and up to date.

3. Account Responsibility

The Client is solely responsible for:

• Maintaining confidentiality of account credentials
• All activities conducted under the account
• Ensuring hosted content complies with all applicable laws
• Maintaining independent backups of all data

Ceyora shall not be liable for data loss under any circumstances.

4. Fees, Billing, and Payments

1. All services are billed in advance unless otherwise agreed in writing.
2. Fees are non-transferable.
3. Failure to pay invoices by the due date may result in:
   • Service suspension
   • Late payment penalties
   • Termination of services
4. Ceyora reserves the right to revise pricing at renewal periods.

5. Refund Policy

1. A 30-day money-back guarantee applies only to Shared Hosting plans purchased for a three (3) year term.
2. Refund requests must be submitted in writing within 30 days of service activation.
3. The guarantee applies solely to hosting fees and excludes:
   • Domain registrations
   • License fees
   • Add-ons
   • Setup charges
4. No refunds shall be issued for:
   • VPS Hosting
   • Dedicated Servers
   • Application Hosting
   • Domain services
   • Renewals
   • Suspended or terminated accounts

6. Domain Services

• Ceyora acts as a reseller of domain registration services.
• Domain fees are non-refundable once registration or renewal is processed.
• The Client agrees to comply with all registry and ICANN policies.
• The Client is responsible for timely renewals.
• Ceyora does not guarantee domain availability.

7. Acceptable Use Policy

The Client shall not use services for:

• Illegal activities under Sri Lankan or international law
• Hosting malware, phishing, or hacking tools
• Spamming or bulk unsolicited email
• Intellectual property infringement
• Child exploitation material
• Activities causing harm to networks, systems, or other users

Ceyora reserves the right to suspend or terminate services immediately without notice for violations.

8. Service Suspension and Termination

• Payment is overdue
• The Client breaches this Agreement
• Services are used unlawfully
• Network security is threatened

No refunds shall be issued upon termination for cause.

9. Intellectual Property

All trademarks, software, systems, and branding of Ceyora remain the exclusive property of the Company. Clients retain ownership of their content but grant Ceyora permission to host and transmit such data for service delivery.

10. Disclaimer of Warranties

Services are provided “as is” and “as available” without warranties of any kind, express or implied. Ceyora does not guarantee:

• Continuous uptime
• Error-free operation
• Data integrity

11. Limitation of Liability

• Loss of data
• Loss of profits
• Business interruption
• Indirect or consequential damages

Total liability shall not exceed the fees paid by the Client for the affected service during the preceding six (6) months.

12. Indemnification

The Client agrees to indemnify and hold Ceyora harmless from any claims, damages, liabilities, or expenses arising from:

• Use of services
• Violation of laws
• Infringement of third-party rights

13. Force Majeure

Ceyora shall not be liable for failure or delay caused by events beyond reasonable control, including natural disasters, war, government actions, cyberattacks, or power failures.

14. Modifications

Ceyora reserves the right to modify these Terms at any time. Continued use of services constitutes acceptance of updated terms.

15. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of Sri Lankan courts.

16. Entire Agreement

This document constitutes the entire agreement between the parties and supersedes all prior communications.
